All images, text, graphics, and other creative content on this website are the exclusive property of yamworks.com and are protected by Bulgarian and international copyright laws. Unauthorized use, reproduction, distribution, or modification of any content on this website is strictly prohibited without the prior written consent of the copyright owner. In the same way, the use of any imagery, text, or creative assets from yamworks.com as a basis, reference, or component for the creation of new or derivative works—including but not limited to digital composites, paintings, illustrations, or AI-generated content—is strictly forbidden without the prior written consent of the copyright owner. 2. Creative Rights & Edition Policy

To maintain artistic freedom and business flexibility, yamworks.com explicitly reserves the following rights:

  • Alternative Edits: We reserve the right to produce, showcase, and sell different artistic edits, color grades, or crops of the same original image.
  • Limited Edition Definition: A “Limited Edition” designation applies strictly and exclusively to a specific artistic looks.
  • Variations of the Same Photograph: We reserve the right to release separate and distinct editions derived from the same photograph (source file/negative). Changes in post-production, color grading, monochrome conversion (B&W), or cropping constitute a new artistic interpretation and thus a separate edition.
  • Subject & Location Consistency: Furthermore, the artist reserves the right to capture and sell multiple distinct works featuring the same subject, location, or composition. Variations in camera/lens choice, camera handling technique, exposure settings, timing, season, lighting and environmental conditions (e.g., weather, time of the day, artificial lighting, flash arrangement) at the time of capture each constitute a separate work and may be sold as its own limited or edition.
  • Contests & competitions: yamworks.com reserves the right to submit any pictures or artworks to photography contests, awards, or competitions at any time.
  • Dedication of the prints: The text you enter at checkout is subject to moderation. The text you introduce at checkout is actually subject to moderation. NOTHING offensive and/or CONTRADICTORY to the vision of the artist WILL BE ALLOWED.
  • Dedication of the prints: yamworks.com reserves the right to distribute ad discretion material about the production/packaging of the several steps involved in producing a finished product. This includes, but is not limited to, social media platforms like Facebook, Instagram and TikTok.
  • Dedicative works: Some of the institutions (like DACS) granting yamworks.com right to sell photographs based on famous paintings require yamworks.com to provide one copy of the print upon their request. yamworks.com is OBLIGED to provide them such a copy. However, that’s a copy for their record. It won’t have the same certificate of authenticity and the same metal engraved plate customized for the collectors.
  • Other Usages of Images & Distinction of Authenticity: yamworks.com reserves the right to use, license, and reproduce any image for other purposes—including books, magazines, exhibitions, or digital media—regardless of whether the image is also part of a limited print series. Such usage does not constitute an addition to the physical print edition count. Those images are “reproductions” subject to the following considerations:
    • Published Media: Numbering within a book or catalog or other media type refers to the edition of the media itself, not the image. A numbered book/magazine/other does not carry the same Certificate of Authenticity, the same custom-made accessories, or the hand-finished properties of a physical print.
    • Non-Equivalence: Acquisition of a numbered book/magazine/other does not grant the owner any claim to the limited physical print series. These are distinct artistic objects and are marketed, valued, and recorded as separate entities in the yamworks.com archive.
    • Attribution of Original Edition: To maintain the historical integrity of both the yamworks.com archive and the collectors’ archives, all reproductions—including those in books, catalogs, or other media will include a disclaimer to the image’s status as a reproduction of a Limited Edition Physical Print. Whenever legally possible and with the consent of the collectors, their name will be included in the disclaimer note. If his/her name cannot be included in the disclaimer for whatever reason, the image won’t be provided to anybody for any purpose.

3. Collector’s Ownership & Usage Rights

When you purchase a print from yamworks.com, you are granted a “Restricted Ownership” of that specific physical unit:

  • Physical Possession & Resale: You own the physical artwork. You have the right to display, gift, or resell a specific piece of artwork. However, the sale does not constitute a transfer of copyright. None of the parties involved may reproduce, scan, or commercially exploit the work without the explicit written consent from the artist.

4. Artistic Integrity & Representation

  • Integrity of Work: The artwork may not be distorted, mutilated, cropped, or modified in any way without the explicit written consent from the artist.
  • Color Accuracy: The images at yamworks.com have been exported for displaying purposes.The physical print may vary in tone, saturation, or contrast from the digital preview on your screen. These variations are a natural part of the exporting to JPG/PNG for displaying on a screen, printing, and the calibration/accuracy of different screens.
  • Public Attribution: If a print is featured in a media publication, clear credit must be given to yamworks.com.

5. Distribution & Promotional Use

yamworks.com reserves the right to share and distribute content from this website on social media for marketing or educational purposes, and to authorize the editorial use of imagery in magazines, newspapers, books, and other digital or printed publications. All such published images are marked as reproductions and are not part of any numbered limited edition. Where an image has already been sold at the time it is provided for publication, we will—with the collector’s consent and where the medium allows—credit the owner. In this way we respect the heritage of our collectors while sharing these stories with a broader audience.

6. Non-Profit & Philanthropy

yamworks.com may, at its sole discretion, provide exhibition copies for non-profit, educational, or exhibition purposes. These items are never original artworks and are governed by the terms below.

Consent for unique (1-of-1) works: Because an exhibition copy of a unique work touches its exclusivity, no exhibition copy of a 1-of-1 image is made for any non-profit purpose unless the collector has consented. This consent is requested from the collector by email at the time of acquisition and recorded with the sale. Where a collector declines, or where no consent is on record, no exhibition copy of that work will be produced. The above consent requirement applies solely to unique 1-of-1 works. It does not apply to limited editions of many because those images are issued as a defined series of multiple prints, no single collector holds exclusivity over the image, and exhibition copies of them may be produced without individual collector consent.

All exhibition copies provided under this program are further governed by the following terms:

  • No Resale or Transfer. The recipient may not sell or auction the exhibition copy; it is for display or study only. Donating it to a third party is permitted only with the prior explicit written consent of the artist.
  • Not Part of the Edition; No Certificate; No Customized Plate. These items are not counted within any limited edition and do not carry the Certificate of Authenticity and the customized metal plate issued with editioned prints. They never include, in any form, the engraved metal plate that accompanies a collector’s print. Each exhibition copy is clearly marked “H.C.” (Hors Commerce) or “Exhibition Copy.”
  • Origin Disclaimer. Each exhibition copy must carry a disclaimer stating that the image originates from yamworks.com and pointing back to the official archive at yamworks.com and, where relevant, the collectors’ archives. This keeps the historical record of the work clear. For exhibition copies of unique (1-of-1) works, and whenever legally possible and with the collector’s consent, the owner’s name is included in the disclaimer; where it cannot be included, the disclaimer still states the work’s origin.

7. Prohibition of AI Training & Generative Usage

All images, text, and metadata hosted on yamworks.com are the exclusive intellectual property of the artist. As such, the following strict prohibitions apply to any and all content found on this platform:

  • Strict Prohibition: The use of any content from this site—including but not limited to original artworks, “Selections,” or “Reproductions”—for the purpose of training, fine-tuning, or developing Artificial Intelligence (AI) models, machine learning algorithms, or any automated generative technologies is strictly prohibited.
  • Derivative Works: Using these images as a basis, reference, or “seed” to generate new AI-created imagery is a violation of these terms and constitutes copyright infringement.
  • Opt-Out Notice: This site explicitly opts out of any “fair use” or “public domain” scraping for direct or indirect AI development. Any bypass of technical measures to harvest data for AI training or commercial datasets is a direct violation of yamworks.com‘s terms of use.

8. Enforcement

This website and its content may not be copied, reproduced, republished, or distributed in any way without written permission. Any unauthorized use—including the creation of derivative works, automated data scraping for AI training, or commercial reproduction—constitutes a violation of copyright and may result in legal action.
